In civil litigation, a lawsuit in which the parties themselves do not appoint a lawyer as their legal representative. Unlike Germany, Japan does not have a mandatory lawyer system, so lawsuits by the parties themselves are permitted, and in summary courts, lawsuits by the parties themselves in which neither party appoints a lawyer account for nearly 90% of lawsuits, and 20% of lawsuits in district courts. In particular, in summary courts, lawsuits by the parties themselves were conducted with the advice of judicial scriveners, so in small claims lawsuits, it is permitted for the parties to be represented by certified judicial scriveners. 民事訴訟において、当事者が弁護士を訴訟代理人としないで自分で行う訴訟。日本は、ドイツと異なり弁護士強制主義をとっていないため、本人訴訟が許されており、当事者双方とも弁護士を選任しない本人訴訟が簡易裁判所で90%近く、地方裁判所で20%もある。特に簡裁での本人訴訟は司法書士の助言のもとに行われていた実情を踏まえて、少額訴訟において認定を受けた司法書士による訴訟代理が認められている。
