In non-life insurance, when an insurer compensates for a loss, the insurer automatically acquires the rights that the insured had regarding the subject matter of the insurance and the rights that the insured has against third parties. The former is called subrogation (Commercial Code Article 661), and the latter is called subrogation (Article 662). This prevents the insured from receiving double benefits and aims to lower the insurance premiums for the entire contract. Even if the insurer acquires rights against third parties through subrogation, the insurer can only exercise those rights to the extent that it does not impair the exercise of the rights of the insured or the policyholder against third parties. 損害保険において保険者が損害の填補をした場合,被保険者が保険の目的についてもっていた権利および被保険者が第三者に対してもつ権利を法律上当然に取得すること。前者を残存物代位といい (商法 661) ,後者を請求権代位という (662条) 。被保険者の二重利得を防止するとともに契約全体として保険料の低廉化をはかったもの。保険者は代位により第三者に対する権利を取得しても,被保険者または保険契約者の第三者に対する権利の行使を害さない範囲においてのみ,その権利を行使できる。
