In international private law, intentional manipulation of connective elements, which are the intermediary used to determine the applicable law, to make the law that is most convenient for oneself the applicable law. A famous example is a man who once married in Scotland to avoid English laws regarding marriage. Another example in the United States is the practice of establishing a company in Delaware, which is favorable for company formation, and locating the actual headquarters in another state, which is also an example of circumvention of law in a broad sense. There are some who believe that circumvention of law should not be allowed, but the prevailing view is that it is basically valid as long as it uses connective elements that can be manipulated, and that any adverse effects can be regulated by mandatory laws that should be applied regardless of the applicable law. 国際私法上,準拠法を導き出す媒介となっている連結素を故意に操作し,自己に都合のよい法律を準拠法とすること。かつて,婚姻締結に関するイングランド法を回避するため,スコットランドで婚姻をした例などが有名である。また,会社の設立に有利なデラウェア州で会社を設立し,実際の本拠は他の州に置くというアメリカで行われている例も,広い意味での法律回避である。法律回避を許さないとの考え方もあるが,基本的には操作できる連結素を用いている以上はこれを有効とし,弊害については,準拠法にかかわりなく,適用されるべき強行法規による規制をすれば足りるとの考え方が有力である。
