One of the types of conduct that the Antimonopoly Act regulates. The main requirement is that an enterprise cooperates with other enterprises to mutually restrict or carry out their business activities, thereby substantially restricting competition in a certain field of trade against the public interest (Article 2, Paragraph 6 of the Antimonopoly Act). In short, it is a so-called cartel conduct that restricts competition by agreement. 独占禁止法が規制の対象としている行為類型の一つ。主要な要件は,事業者が他の事業者と共同して,その事業活動を相互に拘束しまたは遂行することにより,公共の利益に反して,一定の取引分野における競争を実質的に制限することである(独占禁止法2条6項)。端的にいえば,合意によって競争を制限するいわゆるカルテル行為である。制限される競争の態様によって,価格,生産制限,市場分割等々の各種の〈不当な取引制限〉が存在する。
