Guarantor - guarantor

A person who provides his/her own property as collateral for another person's debt. For example, if person C mortgages his/her own land for person A to secure person B's debt to person A, person C is called a guarantor. Although the word guarantor is used, whereas a general guarantor is indebted to the creditor, a guarantor is not indebted, but is only responsible for allowing the security interest to be exercised against the secured property in the event that the debtor does not repay the debt. However, a guarantor whose security interest has been exercised, or who has paid the debt himself/herself to avoid it being exercised, is in the same position as a guarantor, and is therefore given the same right of reimbursement from the debtor as a guarantor, but is not allowed to obtain reimbursement in advance (Civil Code Article 460).

自己所有の財産を他人の債務の担保に提供する人。たとえば、乙の甲に対する債務を担保するために、丙が自分の土地に甲のために抵当権を設定する場合の丙を物上保証人という。保証人ということばが用いられるが、一般の保証人が債権者に対して債務を負うのに対して、物上保証人は債務を負うことはなく、債務者が債務を弁済しない場合に、担保の目的となった財産に対して担保権が実行されるのを認める責任を負うだけである。しかし、担保権を実行された物上保証人、あるいは実行されるのを免れるために自ら弁済した物上保証人は、実質的に保証人と同じ立場にたつので、保証人と同様に債務者に対する求償権が与えられるが、事前の求償権（民法460条）は認められない。
