Stamp duty

This is a type of circulation tax that is levied when a transfer of property occurs, assuming that there is tax-paying capacity behind it.When a document is created to certify the creation, transfer, change, or extinction of a property right, the creator of the document pays the tax by affixing a revenue stamp to the document.

In order to clarify the scope of taxation, items subject to stamp duty are listed in the table of taxable items in Schedule 1 of the Stamp Duty Act (Act No. 23 of 1967) based on the limited enumeration principle, and the definition of the tax base and tax rate are also shown for each of the 25 categories of taxable items. For example, for contracts relating to the transfer of real estate, mining rights, intangible property rights, ships or aircraft, or businesses, contracts relating to the establishment or transfer of surface rights or land leases, contracts relating to consumption loans, and contracts relating to transportation, the tax base for contracts that state the contract amount is set at a fixed tax rate of 11 levels, ranging from 200 yen to 600,000 yen per copy, depending on the contract amount, ranging from less than 100,000 yen to more than 5 billion yen.

In the fiscal 2009 budget, total tax and stamp revenues were 46.103 trillion yen, of which stamp revenues were 985 billion yen, accounting for 2.13%.

物財の移転が行われる場合に、その背後に担税力があると想定して課される流通税の一種で、財産権の創設、移転、変更または消滅を証明すべき証書を作成した場合に、その作成者が証書に収入印紙を貼(は)り付ける形で納める税である。

　課税範囲を明確にするために、印紙税を課される物件が限定列挙主義に基づいて印紙税法（昭和42年法律第23号）別表第1の課税物件表に列挙されており、課税標準の定義や税率も25に分類された課税物件ごとに示されている。たとえば、不動産、鉱業権、無体財産権、船舶もしくは航空機または営業の譲渡に関する契約書、地上権または土地の賃借権の設定または譲渡に関する契約書、消費貸借に関する契約書、運送に関する契約書に対して、課税標準は契約金額の記載のある契約書については、10万円以下のものから50億円を超えるものまで契約金額の区分に応じ、一通につき200円から60万円まで11段階にわたって一定の税率が定められている。

　2009年度（平成21）予算における租税および印紙収入総額46兆1030億円に対して印紙収入額は9850億円であり2.13％を占める。
