Minor offense disposition - Bizaishobun

Japanese: 微罪処分 - びざいしょぶん

When a judicial police officer handles a minor crime by not referring the case to a public prosecutor, the police handle it themselves. This is done for cases that the public prosecutor has designated as not requiring referral (Proviso, Article 246 of the Code of Criminal Procedure). In practice, cases designated for referral are those involving adults with particularly minor circumstances, such as theft and fraud. For juvenile cases, only summary referral is permitted, and minor offense dispositions are not possible. In addition, when a public prosecutor decides not to prosecute because the case is minor (Article 248), this is also sometimes called a minor offense disposition.

軽微な犯罪につき司法警察員が事件を検察官に送致せず，警察限りで処理すること。検察官が，送致を不要として指定した種類の事件について行われる (刑事訴訟法 246但書) 。実際には，成人の刑事事件で，犯情の特に軽微な窃盗詐欺事件などが指定されている。少年事件については，簡易送致が許されるだけで，微罪処分はできない。なお，検察官が事案軽微のゆえに不起訴とすること (248条) も，微罪処分と呼ばれることがある。
