A civil law scholar from the Meiji and Taisho periods. Son of Tomi Masatsune, a samurai at Shogoin in Kyoto. After graduating from Tokyo School of Foreign Languages, he studied law at the University of Lyon in his spare time while working at the Museum of Asian Art in Lyon, France. In 1884 he became a professor at the University of Tokyo, in 1891 he was an Imperially appointed member of the House of Peers, and in 1892 he gave an important speech in opposition to the implementation of the Civil Code. Together with Ume Kenjiro and Hozumi Nobushige, he drafted the Civil Code, and played a leading role as chief examiner in the drafting of the Commercial Code and the Code of Civil Procedure. He was also knowledgeable about German law, and was a pioneer in the study of German civil law, and one of the Seven Doctors who advocated a hard-line stance against Russia. In 1918 he became a Privy Councilor and a judge at the Permanent Court of International Arbitration, and in 1922 he became a baron. After the Taisho period, he continued to serve as the chairman of the investigation committee and the chairman of the committee that drafted the revised draft on the issue of family law reform. His work, "Minpo Genron," along with Ume's "Minpo Yōgi," is an important document of civil law theory for legislators. <Books> Code civil du Japon

明治大正期の民法学者。京都聖護院侍富井政恒の子。東京外国語学校卒業後フランス・リヨン東洋博物館勤務の余暇にリヨン大学で法学を学ぶ。明治17(1884)年東大教授,24年貴族院勅選議員,25年民法典実施に反対の大演説をした。梅謙次郎,穂積陳重と民法典を起草,商法,民事訴訟法の起草にも主査委員長として指導的役割を果たした。ドイツ法にも詳しく,ドイツ民法研究の先駆者で,対露強硬論を唱えた七博士のひとり。大正7(1918)年枢密顧問官,常設国際仲裁裁判所裁判官,15年男爵となる。大正期以後も家族法改革問題に関し,調査委員長,改正草案起草委員長を務めた。その著『民法原論』は,梅の『民法要義』とともに,立法者の民法論として重要な文献である。<著作>『刑法論綱』『民法論綱』《Code civil du Japon》
