Due process of law. In Japan, it is also translated as "due process of law" or "due legal process". It is one of the basic concepts of the American Constitution. The Fifth Amendment to the United States Constitution (established in 1791) states that "No person shall be deprived of life, liberty, or property, without due process of law," and the Fourteenth Amendment (established in 1868) states that "No State shall deprive any person of life, liberty, or property, without due process of law." 法の適正な過程。日本においては〈適法手続〉または〈適正な法の手続〉〈法の適正な手続〉とも訳される。アメリカ憲法上の基本的な観念の一つ。合衆国憲法第5修正(1791成立)には,〈何人も……法の適正な過程によらずに,生命,自由または財産を奪われることはない〉という定めが置かれており,同第14修正(1868成立)には,〈州は,何人からも,法の適正な過程によらずに,その生命,自由または財産を奪ってはならない〉という規定がある。
