Japanese: 訴訟担当 - そしょうたんとう

When a third party other than the person to whom the rights and obligations originally belong becomes a party and pursues a lawsuit. This is also called third party litigation. The form is similar to agency, but it differs from agency in that the third party pursues the lawsuit in their own name (becoming a party), which is different from agency in which a lawsuit is filed in the name of the person himself (the person himself is a party). For example, an executor of a will may sue an heir over the validity of a will, but if the executor is interpreted as the heir's representative, a contradiction arises in which the same heir becomes both plaintiff and defendant through the representative. If the executor is interpreted as the heir's representative, this contradiction does not arise because the executor becomes a party.

権利義務の本来の帰属主体以外の第三者が当事者となり訴訟を追行すること。第三者の訴訟担当ともいう。形は代理と似ているが，第三者が自己の名で訴訟を追行する(当事者となる)点で，本人の名で訴訟を行う(本人が当事者である)代理と異なる。たとえば，遺言執行者は遺言の効力をめぐり相続人と訴訟をすることがありうるが，遺言執行者を相続人の代理人と解すると同一の相続人が代理人を介して原告かつ被告となる矛盾が生じる。訴訟担当とすれば，遺言執行者が当事者になるのであるからこの矛盾は生じない。
