Kyo Tsuneto - Tsunetokyo

Legal philosopher. Born December 3, 1888 in Matsue, Shimane Prefecture. During his time at First High School, he formed friendships with Kikuchi Kan and Akutagawa Ryunosuke. After graduating from the Faculty of Law at Kyoto Imperial University in 1916 (Taisho 5), he became a professor at Doshisha University in 1914, an associate professor at Kyoto University in 1922, and a professor there in 1929 (Showa 4). He retired with due honor following the Takigawa Incident in 1933. He then served as a lecturer and professor at Osaka University of Commerce (now Osaka City University), and after World War II he served as president of Osaka City University from 1949 to 1957 (Showa 24 to 1957), and returned to Kyoto University to serve as a professor there from 1946 to 1949. He became a member of the Academy in 1949, and served as president of the Japanese Association of Legal Philosophy from 1962 to 1965. In 1966, he was awarded the Person of Cultural Merit. In his early days, he was influenced by neo-Kantianism and studied the works of Stammler and Rusk, but later, influenced by the philosophy of life (Dilthey, Simmel, etc.) and Hegelian philosophy, he preached his own unique legal philosophy. His major works include "The Life of Law" (1927), "Fundamental Problems of Law" (1936), "The Theory of Legal Personality" (1936), "Philosophy and Jurisprudence" (1969), "The Spirit of Law" (1969), and "Law and Morality" (1969). He passed away on November 2, 1967.

法哲学者。明治21年12月3日島根県松江市に生まれる。第一高等学校時代菊池寛(かん)、芥川龍之介(あくたがわりゅうのすけ)らと親交を結ぶ。1916年(大正5)京都帝国大学法科大学を卒業後、19年同志社大学教授を経て、22年京大助教授、29年(昭和4)同教授となる。33年滝川事件に際し節を全うして退官した。その後大阪商科大学(現大阪市立大学)の講師、教授を経て、第二次世界大戦後は49~57年(昭和24~32)まで大阪市立大学学長を務めるとともに、京大に復職して京大教授を兼任(1946~49)した。49年学士院会員となり、62~65年日本法哲学会理事長を務めた。66年文化功労者。初期には新カント主義の影響下で、シュタムラー、ラスクなどを祖述したが、やがて、生の哲学(ディルタイ、ジンメルなど)、ヘーゲル哲学などの影響下で、独自の法思想を説いた。主著には『法律の生命』(1927)、『法の基本問題』(1936)、『法的人格者の理論』(1936)、『哲学と法学』(1969)、『法の精神』(1969)、『法と道徳』(1969)などがある。昭和42年11月2日死去。
