Talio (Latin)

It is also called retribution or anti-seizure. It is a punishment in which the same kind of harm is inflicted on the perpetrator as the victim has suffered, or the perpetrator is harmed in the same way. The word "talio" comes from the provision of the Twelve Tables of ancient Rome, "If he separates the limbs of another and does not come to terms with it, he is a talio" (Table 8, 2), but it can already be found in the Code of Hammurabi, the Book of Exodus in the Old Testament, and the Quran. This kind of talio can also be found in ancient Greece and ancient China, but it is said that it did not exist in Germanic or Indian countries. In many cases, talio disappeared at a relatively early stage and changed to specific punishments set by the state or compensation for damages in the form of property, but its basic concept is retribution, and this concept had a great influence on the history of punishment.

同害報復刑、反座刑ともいう。被害者が受けたと同種の害を加害者に加え、または同種の方法で加害者を害するものである。タリオの語は、古代ローマの十二表法の規定「もし彼が他人の四肢を分離せしめ、妥協ととのわざるときは、タリオたるべし」（第八表2）に由来するが、すでに古く『ハムラビ法典』や『旧約聖書』の「出エジプト記」やコーランにもみられる。このようなタリオは、前記のほか古代ギリシアや古代中国においてもみられるが、ゲルマンやインドにはなかったとされている。多くの場合タリオは比較的早い段階で消滅し、国家の定める特定の刑罰か、あるいは財産による損害賠償へと変化したが、その基本的考え方は応報であり、この考え方は刑罰の歴史に大きな影響を与えた。
