Codified law is when law exists in the form of a document written in letters, which is its source of existence. In contrast, unwritten law refers to sources of law other than codified law. Codified law is also called statutory law. Japan belongs to the European continental law system, and codified law exists in almost every area of national life. In this way, when codified law is the basis of national law, it is called codification. In contrast, in common-law countries, the accumulation of court precedents forms the core of national law, and they follow either case law or unwritten law. 文字で書きあらわされ文書の形をとるものが法の存在形式=法源となるものを成文法という。これに対して不文法は法源のうち成文法以外のものをいう。成文法は制定法とも呼ばれる。日本はヨーロッパ大陸法系に属しており,国民生活のほとんどすべての分野において成文法が存在するが,このように成文法が国法の基本となっている場合には成文法主義と呼ばれる。これに対して英米法系の諸国では裁判所の判例の集積が国法の基幹的部分を構成しており,判例法主義または不文法主義をとっている。
