The Criminal Code provides for "special provisions for crimes between relatives" regarding property crimes. In other words, property crimes such as theft, theft of real estate, fraud, blackmail, embezzlement, and breach of trust are exempt from punishment when committed between spouses, lineal blood relatives, or relatives living together, but are considered crimes that require a complaint if committed between other relatives (Articles 244, 251, and 255 of the Criminal Code). These are called "family theft cases." The ideological basis for this is the idea that "the law does not enter the home," and that when a certain family relationship exists between the property criminal and the victim (which generally and legally includes both the owner and possessor of the property), it is preferable for the matter to be resolved independently within the family rather than being dealt with under the Criminal Code.
