New system - Shinsei
Laws on noble families issued mainly in the Heian and Kamakura periods in the form of imperial edicts, Dajokan fu, kansen fu, and shogunal edicts based on imperial edicts from the emperor or the retired emperor. They are also called the new system of noble families. In the Kamakura period, similar laws were issued by the shogunate, which was called the new system of warrior families (also called the new system of Kanto). Laws that were imitated by individual noble families and targeted their families were called the new system of households, and the new system of temples was called the new system of temples. They were issued from the mid-10th century, and initially contained many clauses prohibiting government officials from engaging in extravagance (luxury beyond their rank), and after 1040, laws on the reorganization of manors were repeatedly enacted. The new system of Hogen and the new system of Kenkyu issued during the reign of Emperor Goshirakawa and the retired emperor Goshirakawa were different in nature from the previous systems, and aimed to establish medieval royal authority, becoming the basis for subsequent new systems. The Three Generations of Laws was a compilation of the three new systems of Kenkyu, Kanki, and Bun'ei. → New Kocho system

主に平安・鎌倉時代に天皇・院の勅旨に基づき宣旨・太政官符・官宣旨・院宣などの形式で出された公家法。公家新制ともいい,鎌倉時代に幕府が発布した同種の法令を武家新制(関東新制とも),また個々の公家が公家新制にならって家中を対象に制定したものを家中(けちゅう)新制,同じく寺院のそれを寺辺(じへん)新制という。10世紀半ばから発布され,初めは官人の過差(かさ)(身分不相応の奢侈)を禁止する条項が多く,1040年以降は荘園整理の法令が繰り返された。後白河天皇・後白河院の代に出された保元新制・建久新制は従来の新制と性格を異にし,中世王権の確立を目的としたもので,その後の新制の基本となった。なお《三代制符》は建久新制・寛喜新制・文永新制の3新制を集めて開板したもの。→弘長新制
