Personnel Committee - Personnel Committee

An independent administrative commission on personnel administration established in local governments under the Local Public Service Law. It is composed of three members selected by the mayor with the consent of the assembly. It is equivalent to the National Personnel Authority in the country. It is established in prefectures and cities designated by government ordinance. Cities with a population of 150,000 or more and special wards of Tokyo must establish a personnel committee or fairness committee by ordinance. Municipalities with a population of less than 150,000 and unions of local governments have fairness committees. It has authority independent of the appointing authority to ensure the smooth operation of specialized and technical personnel administration and fair personnel affairs. Its main powers include quasi-judicial authority to review requests for measures regarding employees' salaries, working hours and other working conditions, and to review disadvantageous treatment, quasi-legislative authority to establish committee rules for matters that fall under its authority based on laws or ordinances, research and planning related to personnel administration, and administrative authority to recommend salary schedule revisions. The so-called personnel committee recommendations are considered to be a compensatory measure for the restriction of basic labor rights of local public servants.

地方公務員法に基づき地方公共団体に置かれる人事行政に関する独立行政委員会。議会の同意を得て長が選任する3人の委員で構成される。国における人事院にあたる。都道府県および政令指定都市にはかならず設置される。人口15万人以上の市および東京都の特別区には条例で人事委員会または公平委員会を設置しなければならない。人口15万人未満の市町村と地方公共団体の組合には公平委員会が置かれる。専門技術的な人事行政の円滑な運営を確保し、人事の公正を期するため、任命権者から独立した権限を有する。おもな権限として、職員の給与、勤務時間その他の勤務条件に関する措置要求の審査、不利益処分の審査などの準司法的権限、法律または条例に基づきその権限に属せしめられた事項につき委員会規則を制定する準立法的権限、人事行政に関する調査研究・企画立案のほか、給料表改訂の勧告などの行政的権限がある。いわゆる人事委員会勧告は地方公務員の労働基本権制限の代償措置とされている。
