When one's rights are violated, the act of eliminating the violation through one's own power without going through judicial procedures. This term is used in civil law, but in criminal law it is called self-help, and in international law it is called self-help. This was widely accepted in ancient societies, but modern law prohibits this in principle, allowing the protection of state power when rights are violated, and only allows it in cases such as self-defense and emergency evacuation. Any act that violates this prohibition is a crime or tort. However, it cannot be said that it is necessarily prohibited under international law.

自己の権利が侵害されたときに司法手続によらず自己の力で侵害を排除すること。〈じりょくきゅうさい〉ともよむ。民事法ではこの語を用いるが，刑事法では自救行為，国際法では自助という。古代社会では広く認められたが，近代法は権利が侵害されたときには国家権力の保護を求め得るものとし，原則としてこれを禁止し，正当防衛や緊急避難などの場合にのみ認めている。この禁止に反した行為は，犯罪または不法行為となる。ただし，国際法上は必ずしも禁じられているとは言えない。
