Payment guarantee - Shiharaihosho

A check payer (financial institution) is obligated to pay the check amount (Articles 53 to 58 of the Check Law), and the purpose is to increase the creditworthiness of the check. The check must have the words "guarantee of payment" or other indication of payment on the front, and the payer must sign the check with the date. The guarantee must be simple, and any changes made to the information on the check by the guarantee are considered to be absent. A guarantor is obligated to make payment to all check holders, but this is not an absolute obligation like that of an acceptor of a bill of exchange. The guarantor is only obligated to make payment if the check is presented for payment within the presentment period or if a protest or declaration of protest is made. However, in banking practice, guarantees of payment are rarely made, and are replaced by self-paid checks (deposit checks), which have essentially the same effect.

小切手の支払人(金融機関)が小切手金額の支払義務を負う行為(小切手法53条~58条)で、小切手の信用度を高めることを目的とする。小切手の表面に「支払保証」その他支払いをする旨の文字を表示し、日付を付して支払人が署名することを要する。また、支払保証は単純であることを要し、支払保証によって小切手の記載事項に加えた変更は、その記載がないものとみなされる。支払保証人は、すべての小切手所持人に対し支払義務を負うが、為替(かわせ)手形の引受人のように絶対的な義務でなく、呈示期間内に小切手の支払呈示があった場合および支払拒絶証書または支払拒絶宣言の作成手続がとられた場合に限り、支払いの義務を負う。ただし、銀行実務のうえでは、ほとんど支払保証は行われず、実質的に同じ効果をもつ自己宛(あて)小切手(預金小切手)の発行をもってかえられている。
