Generally, it refers to the place or area where payment is to be made as the fulfillment of a debt (see the section on "payment"), but in the case of a bill (check), it refers to the area stated on the security as the place where payment is to be made. It is one of the legal matters that must be stated when issuing a bill (Bills of Exchange Act, Article 1, Paragraph 5, Article 75, Paragraph 4, Checks Act, Article 1, Paragraph 4). Unlike the place of payment, which is the place where payment is to be made, it has a certain degree of breadth that encompasses it. Payment of a bill is made at the place of payment, unless otherwise specified that payment is to be made at a third party, at the place of business or address of the payer or the issuer of the promissory note (Commercial Code, Article 516, Paragraph 2). However, as a bill requirement, it is not necessary to state such a place, but it is sufficient to state the place of payment, which serves as a clue. 一般には債務の履行としての支払をなすべき地点または地域をいう(〈弁済〉の項参照)が,手形(小切手)に関しては,その支払をなすべき地として証券上に記載された地域をいう。手形(小切手)要件,すなわち手形の振出にあたって記載すべき法定事項のひとつ(手形法1条5号,75条4号,小切手法1条4号)である。支払をなすべき地点たる支払場所と異なり,それを包含するある程度の広がりをもつ。手形の支払は支払地内において,とくに第三者方で支払うべき旨の記載のない限り,支払人または約束手形の振出人の営業所または住所でなされる(商法516条2項)が,手形要件としては,そのような地点を記載しなくとも,その手がかりとなる支払地を記載しておけば足りることとしたのである。
