It is translated as a plea of guilty or a plea of indictment procedure. In Anglo-American criminal proceedings, the court summons the defendant to the courtroom, reads the indictment to him, and asks him whether he admits to the facts of the indictment. This procedure is called an affidavit, and if he pleads guilty (no contest), the fact-finding hearing can be omitted and a guilty verdict can be handed down immediately, and only if he pleads not guilty can evidence be examined. Although it helps to speed up trials, there are many issues with the voluntariness and accuracy of the guilty plea, and the fact that there is a deal with the prosecution. Article 319, paragraphs 2 and 3 of the Japanese Code of Criminal Procedure stipulate that a person is not found guilty simply by admitting (confessing) that he is guilty of the crime he is charged with, and prohibits the adoption of this procedure. The summary trial procedure (Article 291-2 of the Code of Criminal Procedure) was stipulated with reference to this procedure.
