罪状認否または起訴認否手続と訳される。英米法系の刑事訴訟では、裁判所が法廷に被告人を呼び出し、起訴状を読んで聞かせ、起訴事実についてそれを認めるか否かをたずねる。この手続をアレインメントといい、有罪の答弁（不抗争の答弁）があれば事実審理を省略し、ただちに有罪の判決を下すことができ、無罪の答弁があったときに初めて証拠調べが行われる。裁判の迅速化に役だっているが、有罪答弁の任意性、正確性、訴追側との取引があるなどの点で、問題の指摘も多い。日本の刑事訴訟法第319条2項・3項は、起訴された犯罪について有罪であることを自認（自白）しただけでは有罪とされない旨を規定し、この手続の採用を禁止している。なお、簡易公判手続（刑事訴訟法291条の2）は、この手続を参考にして規定されたものである。
