Private road - Shido

Private road - Shido

This refers to private land being used as a road, and is the opposite of a "public road." There are various types. The first type is when the owner and manager of a private road limits users, and it is not subject to the Road Traffic Act and other laws. The second type is, for example, a passageway connecting a residential site to a road, and if it meets requirements for shape, width, etc. and is designated as a location by a specific administrative agency based on the Building Standards Act, then changes or abolition are restricted. The third type is when a private company builds a toll road or other such road for general use, and it is subject to the Road Traffic Act and other laws, and if it is a motorway, it is subject to regulations under the Road Transport Act.

In principle, private roads are managed and maintained by the owner, but in residential areas, local governments may provide support for their maintenance. In addition, in large-scale housing developments, it is common for the roads to be donated to the public free of charge after construction, and become public roads.

民間の土地を道路として使用しているもので「公道」に対する概念である。多様な形態がある。一つは私道の所有・管理者が利用者を限定している場合であり、道路交通法などの対象外である。第二は、たとえば住宅敷地を道路に接続するための通路であり、形状・幅員等の要件を満たし建築基準法に基づいて特定行政庁から位置指定を受ければ変更・廃止が制限される。第三は、民間が敷設して有料道路などとして一般の使用に供する場合であり、道路交通法などの対象となり、自動車道であれば道路運送法上の規制を受ける。

 私道の管理・整備は原則として所有者が行うが、住宅地などで行政が整備を支援することもある。また大規模な住宅地開発では建設後に公共に無償贈与し、公道となるのが通例である。
