Positive law - positive law

A law that is practiced in a certain era and in a certain society. "Practiced" means that the content of the legal norm is generally realized, and in jurisprudence it is said to be "effective." Positive law is opposed to divine law and natural law, which are considered to be binding on people of all eras, regardless of whether they are practiced or not. Positive law is divided into written law and unwritten law, and its characteristics include effectiveness, mutability, and artificiality. Legal positivism considers only positive law to be law.

一定の時代、一定の社会において行われている法。「行われている」とは、その法規範の内容がだいたいにおいて実現していることを意味し、法学上では「実効性をもつ」という。実定法は、それが行われていると否とにかかわらず、あらゆる時代の人々を拘束するものとされる神法や自然法と対立する。実定法は成文法と不文法とに分けられるが、実効性、可変性、人為性などがその特色となっている。実定法だけを法とするのが法実証主義である。
