Execution Order - Execution Order

Administrative legislation that determines the details for enforcing the law. Its basis is Article 73, paragraph 6 of the Constitution. In modern nations, where administrative activities are expanding, administrative legislation is inevitably required. Its practical basis is the need to regulate specialized and technical matters, the need to respond quickly to changes in circumstances, the need to respond to special local circumstances, and the need to deal with matters for which political solutions are not appropriate. There are many examples of executive orders. For example, the Enforcement Order and Enforcement Regulations of the Public Offices Election Act, which are enacted based on said Act. Like delegated orders, executive orders cannot impose penalties, restrict the rights of citizens, or impose obligations without legal delegation.

法律を執行するための細目を定める行政立法。憲法第73条6号に根拠がある。行政活動が拡大している現代国家では、行政立法が不可避的に要請される。その実質的根拠は、専門的・技術的事項を規制する必要、事情の変化に機敏に対応する必要、地方的特殊事情に応ずる必要、政治的解決を適当としない事項に対応する必要などである。執行命令の例はきわめて多い。たとえば、公職選挙法に基づいて制定されている同法施行令、同法施行規則がそれである。執行命令も委任命令と同じく法律の委任がなければ罰則を科したり、国民の権利を制限したり、義務を課すことはできない。
