A document that officially certifies that a debt instrument has enforceable power or the contents of the enforceable power (addressee and object) (Article 26 of the Civil Execution Act). Since the original copy of a debt instrument such as a judgment (which has the same effect as the original kept by the court, etc.) is given to the parties, the creditor submits the original copy of the debt instrument to a notary public (the clerk who keeps the case records in the case of a judgment or record, or the notary public who prepared the instrument in the case of an execution certificate) and has the execution document added to the end. The creditor then submits this (called an "executable original") to the execution agency to enforce the debt. Such notarization is necessary to save the enforcement agency the trouble of investigating the existence of the execution power. → Related Articles Claim Objection Lawsuit Source : Heibonsha Encyclopedia About MyPedia Information |
