At the First Congress on the Law of the Sea in 1958 and the Second Congress on the Law of the Sea in 1960, the principle of "freedom of the seas," which had developed as customary law up until that point, was codified. However, in 1967, the Maltese ambassador at the United Nations proposed that the deep seabed and its resources be managed internationally as the "common property of mankind," which prompted the Third Congress on the Law of the Sea to be held in 1973 to comprehensively review the law of the sea in general. When substantive deliberations began in 1974, the concept of a 200-mile economic zone, which had already been advocated by Kenya at the UN's Expanded Committee on the Peaceful Uses of the Seabed, which had been established as a preparatory meeting for the conference, gained support not only from developing countries but also from Western countries, and became more firmly established as the sessions progressed.

1958年の第1次海洋法会議および60年の第2次海洋法会議で，それまで慣習法として発展してきた〈海洋自由〉の原則が法典化された。しかし，67年国連でマルタの大使が深海海底とその資源を〈人類共同の財産〉として国際的に管理すべきことを提唱したことに端を発し，海洋法一般について総合的に見直すため，73年に第3次海洋法会議が開催された。74年に実質審議が開始されると，すでに同会議の準備会議のため発足していた国連の拡大海底平和利用委員会でケニアが提唱していた200カイリ経済水域の概念は，発展途上国のみならず西欧諸国の支持も得て，会期を重ねるとともに確固たるものとなった。
