Notary Public

Notaries are not public officials as defined by the National Public Service Law, but are in charge of national public affairs based on the Notary Public Law (Law No. 53 of 1908) and other laws, and are therefore essentially national public officials. Notaries' duties include preparing notarized documents of legal acts (contracts, wills, etc.) and other facts related to private rights, certifying private documents (documents to be sent abroad, articles of incorporation, certified copies, etc.), and attaching fixed dates. There is a qualification exam to become a notary public, but in reality, notaries are appointed by the Minister of Justice from among judges, prosecutors, lawyers, etc. Notaries belong to a Legal Affairs Bureau or a District Legal Affairs Bureau, perform their duties at a notary public office, and are supervised by the Minister of Justice. They do not receive a salary from the state, but cover all office management and other expenses from fees received from clients.

国家公務員法に定める公務員ではないが、公証人法(明治41年法律53号)等に基づき国の公務をつかさどっているので、実質的意味における国家公務員である。公証人の職務は、法律行為(契約、遺言等)その他私権に関する事実についての公正証書の作成、私署証書(外国に送付する文書、定款、謄本等)の認証、確定日付の付与等である。公証人になるための資格試験があるが、実際には、裁判官、検察官、弁護士などのなかから法務大臣によって任命される。公証人は、法務局または地方法務局に所属し、公証人役場で職務を行い、法務大臣の監督を受ける。国家から給与を受けず、嘱託人から受ける手数料収入によって事務所の経営その他いっさいの経費をまかなっている。
