Joint tort - joint tort law
It refers to a joint tort committed by multiple persons. Joint tort means that there is an objective connection between the acts of each person, even if there is no joint intention between them. Instigators and aiders are also considered joint tortfeasors (Civil Code, Article 719, Paragraph 2). Joint tortfeasors must jointly compensate for damages (Civil Code, Article 719, Paragraph 1). However, this solidarity does not arise with a common purpose, as in ordinary joint and several obligations, so there is no burden between the debtors (unreal joint and several obligations).

複数の者が共同で不法行為を行うことをいう。共同とは,各自の行為の間に意思の共同がなくても客観的な連関があればよいとされている。また,教唆者,幇助者は共同不法行為者とみなされる (民法 719条2項) 。共同不法行為者は連帯して損害を賠償しなければならない (719条1項) 。しかし,その連帯というのは,通常の連帯債務のように共同の目的をもって発生したものではないから,債務者の間に負担部分はないものとされている (不真正連帯債務) 。
