…Especially during the 19th century German common law era, there was a doctrinal battle over the nature of agency. There were theories that (1) an agent merely expresses the will of the principal and the principal is the true actor (principal act theory), (2) an agent partly expresses his own will and partly the will of the principal and both the principal and the agent are actors (joint act theory), but (3) the prevailing theory was that an agent only expresses his own will and the principal only receives the effects of it (agency act theory). The agency act theory was adopted in the German Civil Code and is also the basis for the agency provisions in the Japanese Civil Code. …
