Detention for evaluation - Kanteiryuuchi

When necessary to perform an evaluation of the mental (such as criminal responsibility) or physical condition of a defendant or suspect, the court may detain the defendant or suspect in a hospital or other location for a specified period of time (Criminal Procedure Law, Article 167; Criminal Procedure Rules, Articles 130-2 to 130-5). When an investigative agency requests an evaluation, if this measure is necessary, it must request it from a judge (Criminal Procedure Law, Article 224). Since detention for evaluation is a measure that restricts physical freedom, a detention warrant for evaluation is required (Criminal Procedure Law, Article 167, Paragraph 2), and the provisions regarding detention apply mutatis mutandis, except for bail (Criminal Procedure Law, Article 167, Paragraph 5; Criminal Procedure Rules, Article 131). When a defendant or suspect is already in detention, the execution of the detention warrant is suspended while it is being executed, and the procedure for detention is to be taken upon the expiration of the detention period (Criminal Procedure Law, Article 167, Paragraph 2).

被告人または被疑者の心神（責任能力など）や身体に関する鑑定をさせるにあたって、必要がある場合に、裁判所が、期間を定めて被告人または被疑者を病院その他の場所に留置すること（刑事訴訟法167条、刑事訴訟規則130条の2～130条の5）。捜査機関が鑑定を嘱託する場合にこの処分を必要とするときは、裁判官にこれを請求しなければならない（刑事訴訟法224条）。鑑定留置は身体の自由を拘束する処分であるから、鑑定留置状を必要とし（同法167条2項）、保釈を除いて、勾留(こうりゅう)に関する規定が準用される（同法167条5項、刑事訴訟規則131条）。被告人または被疑者がすでに勾留されているときは、鑑定留置状が執行されている間、勾留はその執行を停止されたものとして扱われ、留置期間の満了により勾留のための収監手続をとることとされている（刑事訴訟法167条の2）。
