Permanent right of defense

...A right of private law that can prevent the exercise of a claim. For example, the seller and the buyer, who are parties to a sales contract, are each granted the right to simultaneous performance (Civil Code Article 533). In other words, if the seller demands payment without providing the object, the buyer can refuse to pay the price until the object is delivered, and conversely, if the buyer demands delivery of the object from the seller without providing the price, the seller can refuse delivery until the price is paid.
