Schikane

… In ancient Roman law, the principle of individualistic freedom of exercise of rights was dominant, as shown by the legal proverb "He who exercises a right does no wrong to anyone." However, the exercise of rights with the subjective intent of harming others was still prohibited (prohibition of schikane). The 19th century French court decisions, which are considered to be the beginning of the modern theory of abuse of rights, also began with a prohibition of schikane, and the German Civil Code, which was promulgated in 1896 and came into force in 1900, also prohibits only the exercise of rights with such malicious intent (Article 226). …
