Radio Law - Denpaho

The purpose of this law is to promote the public welfare by ensuring the fair and efficient use of radio waves. It was enacted in 1950, Act No. 131. Radio waves were previously controlled by the government, but this law opened them up as a common property of the people. When the Radio Law was enacted, there were only about 5,000 radio stations, but the number has increased rapidly since then, mainly due to mobile phones, against the backdrop of economic development, technological progress, and diversification of communication demand. Radio waves are also used in a wide range of fields, including broadcasting, telecommunications, transportation, fisheries, meteorology, disaster prevention, public safety, and electricity. The Radio Law provides for radio station licenses, object regulations on radio equipment, personal regulations on radio operators, regulations on the operation of radio stations, supervisory authority, objections and lawsuits, the establishment of the Radio Regulatory Council, penalties, etc., and is the basic domestic law on radio wave use. The law is also being reviewed to make timely use of advances in information and communication technology.

電波の公平かつ能率的な利用を確保することによって、公共の福祉を増進することを目的とする法律。昭和25年法律第131号。従来、電波は政府によって一手に掌握されていたが、この法律によって、国民の共有財産として開放された。電波法制定時約5000局にすぎなかった無線局は、その後の経済発展、技術進歩、通信需要の多様化を背景に、携帯電話を中心に急増している。また、電波の利用分野も、放送、電気通信、運輸、漁業、気象、防災、治安、電力など広範な分野に及んでいる。電波法は、無線局の免許、無線設備に関する対物的規制、無線従事者に関する対人的規制、無線局の運用に関する規制、監督権限、異議申立ておよび訴訟、電波監理審議会の設置、罰則などについて規定しており、電波利用についての国内的な基本法である。情報通信技術の進歩を適時に活用するため本法の見直しも進められている。
