…When both parties assert the existence of their own authority, it is called a positive authority dispute, and conversely, when both parties deny their own authority, it is called a negative authority dispute. The system of authority disputes (Kompetenzkonflikt in German, conflit d'attribution in French) originally developed mainly in France and other German countries as a system to resolve conflicts of positive or negative authority between judicial and administrative judicial institutions, which were different in system, and which arose as a result of the separation of judicial and administrative judicial institutions with the adoption of the administrative judicial system. As a method of resolving authority disputes between the two institutions, since there is no common superior institution between the two institutions, the system of authority trial as a special adjudication institution/procedure has been established, or one institution is given the authority to decide authority disputes (called the authority Kompetenz-Kompetenz, meaning the authority to determine authority), or even the authority of both institutions (for example, the institution that first handled the matter) has been devised equally. …
