This refers to the legal appearance in the German law theory Rechtsscheintheorie. The theory of legal appearance (also called appearance theory or appearance doctrine) is a theory that when there is a legal appearance that is different from the truth, if the person who created that appearance is responsible in some way, those who acted in reliance on that appearance should be protected rather than the person who created it. ドイツ法における理論である〈法外観の理論Rechtsscheintheorie〉にいう法外観をさす。〈法外観の理論(外観理論,外観主義ともいわれる)〉とは,真実と異なった法的外観がある場合に,その外観を作りだした者になんらかの責任があるときは,その者よりも,その外観を信頼して行動した者を保護すべきだという理論である。英米法における禁反言(エストッペル)と近似しており,取引の安全を保護する機能を持つ。
