This refers to the legal appearance in the German law theory Rechtsscheintheorie. The theory of legal appearance (also called appearance theory or appearance doctrine) is a theory that when there is a legal appearance that is different from the truth, if the person who created that appearance is responsible in some way, those who acted in reliance on that appearance should be protected rather than the person who created it. It is similar to estoppel in Anglo-American law and has the function of protecting the safety of transactions. Source: Heibonsha World Encyclopedia, 2nd Edition Information |
