Leading question - leading question

It is an interrogation that suggests the statement expected by the interrogator. In a typical case, it is an interrogation that can be answered with "yes" or "no". For example, it is acceptable to ask what time it was, but asking "was it not 5 p.m.?" is a leading question. Leading questions are not permitted in direct and re-direct examinations as a rule (Criminal Procedure Rules, Article 199-3, Paragraph 3 and Article 199-7, Paragraph 2). In the case of direct examination, the interrogator and the person making the statement are in a friendly relationship, and there is a high risk that the person will make a statement in response to the suggestion. In contrast, in the case of cross-examination, there is no such relationship, so leading questions are permitted (Criminal Procedure Rules, Article 199-4, Paragraph 3). Therefore, even in the case of direct examination, if there is no risk of pandering, leading questions are permitted (Criminal Procedure Rules, Article 199-3, Paragraph 3, proviso and Article 199-7, Paragraph 2). However, the presiding judge may restrict such measures in any case if he or she deems it inappropriate (Articles 199-3, paragraph 5, 199-4, paragraph 4, and 199-7, paragraph 2 of the same Rules).

尋問者の期待する供述を示唆するような尋問をいう。典型的な場合は、「はい」「いいえ」で答えることが可能な形での尋問である。たとえば、何時であったかと問うのはよいが、午後5時ではなかったかと問うのは誘導尋問になる。主尋問、再主尋問では原則として誘導尋問は許されない(刑事訴訟規則199条の3第3項、199条の7第2項)。主尋問の場合には、尋問者と供述者が友好的な関係にあり、示唆に迎合して供述する危険が大きいからである。これに対して反対尋問の場合には、そのような関係がないから誘導尋問も許される(同規則199条の4第3項)。それゆえ、主尋問の場合でも、迎合の危険がなければ許される(同規則199条の3第3項但書、199条の7第2項)。とはいえ、裁判長は、相当でないと認めるときはどのような場合にも制限することができる(同規則199条の3第5項、199条の4第4項、199条の7第2項)。
