After divorce (or separation), the parent who does not have custody (or custodial parent) has the right to meet and correspond with his/her minor child. Although the word "right" is used, it is understood to include an element of parental obligation. In Western family law, this tends to be recognized as a general rule. In current Japanese law, there is no specific written basis for this right, so there are disputes over its legal nature and form. In practice, it is subject to family court adjudication as a matter or disposition necessary for the custody of the child. In addition, case law has shown that when the marriage of the parents has broken down and they are living separately, the family court can order appropriate measures regarding visitation negotiations between the parent who does not live with the child by analogy applying Article 766 of the Civil Code (matters or dispositions necessary for the custody of the child). → Related topic: Joint custody Source : Heibonsha Encyclopedia About MyPedia Information |
