Japanese: 面接交渉権 - めんせつこうしょうけん

After divorce (or separation), the parent who does not have custody (or custodial parent) has the right to meet and correspond with his/her minor child. Although the word "right" is used, it is understood to include an element of parental obligation. In Western family law, this tends to be recognized as a general rule. In current Japanese law, there is no specific written basis for this right, so there are disputes over its legal nature and form. In practice, it is subject to family court adjudication as a matter or disposition necessary for the custody of the child. In addition, case law has shown that when the marriage of the parents has broken down and they are living separately, the family court can order appropriate measures regarding visitation negotiations between the parent who does not live with the child by analogy applying Article 766 of the Civil Code (matters or dispositions necessary for the custody of the child).

離婚（もしくは別居）した後，親権者（もしくは養育親）とならなかった方の親が，自分の未成年の子と面会・文通などをする権利。〈権〉という文字が使われているが親としての義務の要素も含むと解される。欧米の家族法では，原則的に認められる傾向にある。日本の現行法では特に明文的な根拠がないため，その法的性質や態様のあり方などをめぐって争いがある。家庭裁判所の実務では，子の監護に必要な事項または処分として家事審判の対象とされている。また，判例上，父母の婚姻が破綻して別居状態にある場合に，家庭裁判所は，民法766条（子の監護に必要な事項または処分）を類推適用して，子と同居していない親と子の面接交渉について相当な処分を命ずることができるとされている。
