Horiki lawsuit
Following the Asahi lawsuit, this lawsuit was called the second lawsuit for the right to life. In 1970, Horiki Fumiko, who was completely blind, divorced, and raising two children, and who received a non-contributory disability welfare pension under the National Pension Law, applied to a welfare office for child support allowance under the Child Support Allowance Law. However, her application was rejected because the Child Support Allowance Law contained a provision prohibiting the concurrent payment of public pension benefits and child support allowances. The plaintiff filed an administrative appeal, but this was also rejected. The plaintiff then filed this lawsuit in the same year, claiming that the prohibition on concurrent payments violates the right to life under Article 25 of the Constitution, and that the situation in which the prohibition on concurrent payments applies to single-mother households, while the concurrent payment is permitted in single-father households, violates the principle of equal protection under Article 14 of the Constitution. She sought the reversal of the rejection decision, along with the unconstitutionality of the prohibition on concurrent payments.

朝日訴訟についで,第2の生存権保障訴訟と呼ばれた訴訟。国民年金法の無拠出障害福祉年金を受けている,全盲で,離婚中の身で2人の子供を扶養していた堀木文子が,1970年,児童扶養手当法に基づく児童扶養手当の支給を福祉事務所に申請したところ,児童扶養手当法の規定中に公的年金給付と児童扶養手当との併給を禁止する規定があるからという理由で,その申請は却下され,原告は,行政不服申立をしたがこれも却下された。そこで原告は,この併給禁止は憲法25条の生存権保障に違反しており,また,生別母子世帯の場合にこの併給禁止が適用され,生別父子世帯の場合に併給が容認されている状況は憲法14条の平等保障原則に反するとして,併給禁止規定の違憲とあわせてこの却下処分の取消しを求めて,同年この訴訟を提起した。
