Abbreviation for the Law Concerning the Prevention and Punishment of Theft, etc. (promulgated in 1930). Also known as the Theft Prevention Law. This law was enacted in the early Showa period to deal with the so-called "preaching robbers" that appeared around Tokyo. It consists of four articles, and its main aims are, first, to expand the scope of legitimate self-defense against certain types of theft and robbery, and second, to increase the penalties for habitual and repeat offenders. Article 1 provides for special provisions for legitimate self-defense. In other words, in the following three cases, killing or injuring the perpetrator in order to eliminate a present danger to one's own or another person's life, body, or chastity is deemed to be legitimate self-defense: (1) when attempting to prevent theft or to recover stolen property; (2) when attempting to prevent someone from entering a person's dwelling or other place by carrying a weapon, climbing over a gate or fence, or breaking a lock; and (3) when attempting to expel someone who has entered a person's dwelling or other place without cause or who has not left a person's dwelling or other place when demanded to do so. 〈盗犯等ノ防止及処分ニ関スル法律〉(1930公布)の略称。盗犯防止法ともいう。昭和初年ころ,東京周辺に出没したいわゆる〈説教強盗〉などに対処するために,制定された法律である。全4条から成り立っているが,その主眼は,第1に,窃盗罪,強盗罪の一定の態様のものに対する正当防衛の成立範囲を広げること,第2に,常習・累犯者に対する刑を加重することの2点にある。 1条は,正当防衛の特例を規定している。すなわち,(1)盗犯を防止しようとするとき,または盗品を取り戻そうとするとき,(2)凶器を持ったり門やへいを乗り越えたりあるいは鍵をこわしたりして,人の住居などに侵入する者を防止しようとするとき,(3)ゆえなく人の住居などに侵入した者,または要求を受けても人の住居などから退去しない者を排斥しようとするとき,という三つの場合において,自己または他人の生命,身体,貞操に対する現在の危険を排除するために犯人を殺傷したときは,正当防衛になるとしている。
