A general term for provisional attachment and provisional disposition stipulated in the Civil Preservation Act (Article 1 and following). It is also called a preservation disposition. In the narrow sense, it refers only to the court procedures of provisional attachment and provisional disposition, excluding the execution procedures. Provisional attachment is a system in which a creditor who has a monetary claim (a claim that can be demanded to pay money) temporarily seizes the debtor's assets equivalent to the amount of the claim, in order to preserve the future enforcement of the claim so that it does not become impossible or difficult. There are two different types of provisional dispositions: "provisional dispositions regarding disputed matters" and "provisional dispositions that determine a provisional status." 民事保全法(1条以下)の定める仮差押えおよび仮処分の総称。保全処分ともいう。狭義では,仮差押え,仮処分の手続のうち,執行手続を除いた裁判手続のみをさす。 仮差押えとは,金銭債権(金銭を支払えと請求できる債権)をもっている債権者が将来行う予定の強制執行が不能・困難にならぬよう,これを保全するため,その債権額に見合う債務者の財産を一時差し押さえ,その財産の現状を維持する制度である。仮処分には,〈係争物に関する仮処分〉と〈仮の地位を定める仮処分〉という,性質の異なる二つの種類がある。
