Conflict of laws

Japanese: 法の抵触 - ほうのていしょく（英語表記）conflict of laws

This refers to a situation in which multiple laws with different contents appear to be applied simultaneously to the same issue. There are many different ways in which conflicts can occur, but when looking at conflicts between national laws, an example would be the relationship between Japanese national law, which maintains monogamy, and Indonesian Islamic law, which allows polygamy. However, the problem is not that each country has a different system or that the contents of the laws differ in themselves. In a relationship that spans two countries, such as when an Indonesian man and a Japanese woman wish to marry, a true conflict occurs when both laws must be applied to establish the marriage.

内容を異にする複数の法律が，同時に同一の問題について適用されるようにみえる事態をいう。抵触のあり方は多様であるが，国家法相互の間でこれをみると，一夫一婦制をとる日本の国法と多妻婚を認めるインドネシア･イスラム法との関係などがその例となる。ただし，それぞれの国がそれぞれ異なった制度をとっていることや法律の内容の相違それ自体が問題なのではない。この両国にまたがる関係，たとえばインドネシア人の男と日本人の女とが結婚しようとするときなどにおいて，この双方の法律がともに，このような結婚の成立にあたって必ず適用されねばならないという趣旨である場合に，真の抵触true conflictが生ずる。
