(1) In civil litigation, it refers to the statements and evidence presented by each of the opposing parties to assert the validity of their own claims or to reject the claims of the other party. Arguments are generally made orally, but written arguments are also possible. In the former case, argument is used synonymously with oral argument.

(2) In criminal proceedings, first, it is used synonymously with trial proceedings; second, it means the questioning and statements of the parties; and third, it refers to the statement of opinions on facts and law, especially from the defendant's side, after the examination of evidence has been completed, and is used in response to the prosecution's closing argument.

(1) 民事訴訟では，対立する当事者が，おのおの自己の請求の理由があることを主張するために，あるいは相手方の主張を排斥するために行う陳述および証拠の申し出をいう。弁論は口頭によってするのが原則であるが，書面による弁論も可能である。前者による場合，弁論は口頭弁論と同義に用いられる。

(2) 刑事訴訟では，第1に公判手続と同義に用いられ，第2に当事者の尋問と陳述を意味し，第3に証拠調べ終了後，特に被告人側からの事実および法律についての意見を陳述することをさし，検察側の論告に対して用いられる。
