Japanese: 不在者 - ふざいしゃ（英語表記）absentee

A person who has left his/her previous address or residence and is not likely to return easily. In cases where the property of an absentee at his/her previous address or residence is left unmanaged, the state may take necessary measures, such as appointing or dismissing an administrator, to protect the interests of the absentee and interested parties such as his/her creditors. If an absentee does not appoint an administrator for the property, or if the authority of the administrator of the property of the absentee has been extinguished, the family court may, upon the request of an interested party or a public prosecutor, order the appointment of an administrator for the property of the absentee and other measures necessary for the management of the property (Civil Code, Article 25). Even if an absentee has appointed an administrator, if the absence of the absentee is unknown, the family court may, upon the request of an interested party or a public prosecutor, reappoint the administrator (Article 26). If the absence of the absentee's life or death is unknown for a long period of time (usually seven years), the family court may declare the absentee missing (Article 30).

従来の住所または居所を去って容易に帰来する見込みのない者。従来の住所または居所にある不在者の財産が管理されないで放置されている場合などには，不在者本人や，その債権者など利害関係者の利益を守るため，国家が管理者を任免するなど必要な措置をとりうることになっている。不在者が財産の管理人をおいていない場合や，不在者のおいた財産の管理人の権限が消滅した場合は，利害関係者や検察官の請求によって家庭裁判所は不在者の財産管理人の選任，その他財産管理に必要な処分を命じることができ (民法 25) ，また不在者が財産管理人をおいている場合でも，不在者の生死が不明なときは，利害関係者または検察官の請求によって，家庭裁判所が財産管理人を改任できる (26条) 。なお不在者の生死不明の状態が長く (普通7年間) 続けば，家庭裁判所は失踪宣告ができる (30条) 。
