1764‐1844 German legal scholar. He studied at the University of Göttingen, where he became a lecturer before becoming a professor in 1792. He became a pioneer of historical jurisprudence as a standard-bearer of the second wave of humanism. While he stood on the Kantian theory of natural law, he rejected the claims of abstraction and generalization seen in rational legal theory since Descartes, because natural law is not directly taken into account in the laws and statutes of specific nations, and argued that individual, historicist observations must be made. This progress can be seen in works such as "Natural Law as a Philosophy of Positive Law," "Course of Civil Law," and "Encyclopedia of New Laws," but his ideas were decisively surpassed in quality by Savigny, who was called the "perfecter of historical jurisprudence" of the next generation.
