Registration of marriage - Nyuuseki

When a person enters an existing family register. This can be when a person is entered into a family register for the first time, like when a newborn child is entered into the family register of his or her parents (original registration), or when a child leaves one family register and enters another, like in the case of adoption (transfer registration). In the case of marriage, a new family register is usually compiled for the couple (Family Register Act, Article 16, Paragraph 1), so when the wife changes to the husband's surname upon marriage, or vice versa, this is not considered a registration. However, if one of the parties to a marriage is already the head of the family register and takes that surname after marriage, the other party will be registered in that family register (Act, Article 16, Paragraph 1, proviso, and Paragraph 2).

ある者が既存のある戸籍に入ること。生まれた子が父母の戸籍に入るように、初めて戸籍に記入される場合（原始的入籍）と、養子縁組のようにある戸籍を出て他の戸籍に入る場合（移転的入籍）とがある。結婚の場合には、夫婦のために戸籍が新たに編製されるのが普通である（戸籍法16条1項）から、結婚によって妻が夫の氏にかわる場合やその逆の場合は入籍とはいわない。ただし、結婚の当事者のうちの一方がすでに戸籍の筆頭者であり、結婚後にその氏を称する場合には、他方当事者はその戸籍に入籍することになる（同法16条1項但書・同条2項）。
