Class action lawsuit - Verbandsklage

Japanese: 団体訴訟 - だんたいそしょう（英語表記）Verbandsklage

This is a litigation method developed in the former West Germany, which gives organizations standing to sue in civil lawsuits (the right to sue) and to carry out litigation. It is stipulated in the Unfair Competition Prevention Act, the Discount Act, the Premiums and Gifts Act, the Act against Restraints of Competition, the Ordinary Terms and Conditions Act, and the Handicrafts Act. This system began when trade associations such as chambers of commerce and handicrafts associations were given the authority to sue to stop individual businesses from violating the rules in order to maintain order in their industries, and it was based on the autonomous powers that these organizations traditionally had under the Zunft system.

旧西ドイツで発展した訴訟方式で，団体に民事訴訟の原告適格(提訴権)を与えて，訴訟を遂行させるもの。不正競争防止法，値引法，景品令，競争制限禁止法，普通取引約款法，手工業法に規定が置かれている。この制度の始まりは，商工会議所，手工業組合などの同業者団体に，業界の秩序を維持するために，個々の業者の秩序違反行為の差止めを訴求する権限が与えられたことにあり，これらの団体がツンフト制度の下で伝統的に有していた自治権能を背景としたものである。
