The manifestation of intention is the source for producing legal effects according to what the actor desires. Since this manifestation of intention is composed of an internal intention to produce an effect and an act of expression, the question arises as to which of these is the substance of the legal effect. Intention-based and expression-based doctrines are different ways of thinking about this issue. Intention-based is a view that takes the position that individual autonomy of will is the source of the effect, and holds that the actor's internal intention to produce an effect is its substance. It is a view that places importance on the actor's intention and is based on the standpoint of static safety.

意思表示は，行為者がみずから欲したところにしたがって法律効果を生じさせるための根源である。この意思表示は，内心的効果意思と表示行為とで構成されているため，法律効果発生の本体はいずれかが問題になる。意思主義･表示主義は，このような問題に関しての考え方の差異である。意思主義は，個人の意思自治が効果発生の根源であるとの立場から，行為者の内心的効果意思がその本体であるとする考え方である。行為者の意思の重視，静的安全の観点に立つ考え方である。
