Personal law principle
A principle in private international law. Personal law is the law that follows a person and applies wherever he or she goes. There are two theories: the principle that domicile law (the law of the place where the party has their domicile) is the principle, and the principle that national law (the law of the country where the party has their nationality) is the principle. The position that advocates the latter theory is called personal law principle, and arose in Italy in the mid-19th century (New Italian School). The principle that personal law applies to certain matters is also called personal law principle, and in Japan, personal affairs, family, and inheritance are subject to the jurisdiction of the national law (Articles 3-6, 13-26 of the Law Act). The principle that the law of a territory governed by law should be applied in principle, regardless of a person's domicile or nationality, is called territorial law principle in private international law.

国際私法上の一主義。属人法とは人に追随して人がどこにいっても適用される法で,住所地法(当事者が住所を有する土地の法)を原則とする説と,本国法(当事者が国籍を有する国の法)を原則とする説がある。後者の説を主張する立場を特に属人法主義と呼び,19世紀半ばイタリアで起こった(新イタリア学派)。なお特定の事項に属人法を適用する主義を属人法主義ということもあり,日本では人事・親族・相続について本国法の管轄に属するとしている(法例3〜6条,13〜26条)。また人の住所,国籍にかかわらず,法の支配する領域においては,原則としてその領域の法を適用すべきであるという主義を国際私法上の属地法主義という。
