This refers to a defendant or suspect in custody meeting with his/her lawyer or family, and receiving documents or items from them (Criminal Procedure Code, Articles 39, 80-81). Defendants in custody have the right to meet and communicate freely and without restriction with their lawyers, and may also meet and communicate with other people within the limits of the law. In contrast, suspects may only meet with their lawyers, and when necessary for an investigation, the investigative agency may specify the date, time, and place (Article 39, Paragraph 3). This designation system is of course recognized as an exception, but in practice, it often prevents suspects from fully exercising their right to meet and communicate with others, and has been the subject of strong criticism. 拘禁中の被告人,被疑者が弁護人や家族と面会,書類もしくは物の授受を行うことをいう (刑事訴訟法 39,80~81) 。勾留されている被告人の場合には,原則として弁護人と自由無制限に接見交通する権利を有するほか,それ以外の者とも法令の範囲内で接見交通することができる。これに対し,被疑者の場合には,その相手は弁護人に限られるうえ,捜査の必要があるとき捜査機関はその日時,場所,時間を指定することができるようになっている (39条3項) 。この指定制度はもちろん,例外的に認められたものであるが,実際にはその運用により,被疑者の接見交通権が十分に行使できなくなることも多く,強い批判の対象とされている。
