Request for review - Shinseikyu

It refers to administrative appeals filed against administrative agencies regarding dispositions or inactions of administrative agencies, which are filed against an administrative agency (a higher administrative agency or an administrative agency in a third-party position) other than the administrative agency that made the disposition (the dispositional agency) or the administrative agency that inactions (the inaction agency) (Article 3, Paragraph 2 of the Administrative Appeal Act). It is distinguished from a protest, which is a means of appeal against the dispositional agency or the inaction agency itself.

A request for review of a disposition is permitted if the dispositional authority has a higher administrative authority and is not the head of the relevant minister or an external bureau or an agency under the minister (if this does not apply, an objection can be filed), or if there is a special provision in the law or ordinance that allows a request for review. In the case of inaction, either a request for review or an objection can be filed. The procedures are set out in the Administrative Appeal Act. Furthermore, there are cases where a request for re-examination of the decision on a request for review is permitted.

行政庁の処分または不作為について、行政庁に対してする行政不服申立てのうち、処分をした行政庁（処分庁）または不作為にかかる行政庁（不作為庁）以外の行政庁（上級行政庁または第三者的立場にある行政庁）に対してするものをいう（行政不服審査法3条2項）。処分庁または不作為庁自身に対してする不服申立ての手段である異議申立てと区別される。

　処分についての審査請求は、処分庁に上級行政庁があって、かつ処分庁が主任の大臣または外局もしくはこれに置かれる庁の長でない場合（これにあたらない場合は異議申立てができる）、または法律、条例に審査請求できる旨の特例がある場合に許される。不作為については審査請求か異議申立てのいずれかをすることができる。その手続は行政不服審査法に定められている。さらに、審査請求の裁決について再審査請求の認められる場合がある。
