Employee organization - employee organization
An organization formed by public servants for the purpose of maintaining and improving their working conditions. After World War II, public servants were granted the three labor rights for a time. However, after 1948, the right to collective bargaining and the right to strike were denied, and the current National Public Servant Law and Local Public Servant Law also deny the formation of ordinary labor unions, and a system of employee organizations different from general labor unions is established (National Public Servant Law, Article 108-2 and onward; Local Public Servant Law, Article 52 and onward). These employee organizations can be formed to negotiate with authorities regarding working conditions, social and welfare activities, etc. Negotiation does not include the right to conclude collective agreements, but organizations under the Local Public Servant Law are granted the right to written agreements (Article 55, paragraph 9). Public servants will not be treated disadvantageously because of the formation or membership of an employee organization or the performance of legitimate organization activities. Police officers, fire officers, prison officers, and members of the Self-Defense Forces are also prohibited from forming such organizations.

公務員がその勤務条件の維持改善をはかることを目的として組織する団体。第2次世界大戦後,公務員については,しばらくは労働三権が認められていた。しかし 1948年以後,団体交渉権と争議権が否認され,さらに現行の国家公務員法および地方公務員法では,通常の労働組合の結成も否認され,一般の労働組合とは異なる職員団体の制度が設けられている (国家公務員法 108条の2以下,地方公務員法 52以下) 。この職員団体は,勤務条件その他社交的または厚生的活動などに関し当局と交渉するために結成することができる。交渉には団体協約を締結する権利を含まないが,地方公務員法上の団体には,書面による協定の権利が認められている (55条9項) 。公務員は職員団体の結成または加入の有無,および団体の正当な行為を遂行したことのために不利益な扱いを受けない。警察職員,消防職員,監獄職員,自衛隊員などは,これの結成をも禁止されている。
